So today before school I went down into the woods and smoked a joint then I hit up this gas station and bought myself something to drink, walked out, and lit up a cig. So im walking down this street to go to school when all of a sudden this cop pulls in right in front of me. I was only a few minutes from school and I had maybe 20 minutes to get there so I knew he couldnt be bitchin about truancy or whatever, I didnt have any more weed on me so I was fine about that so even if he saw me smoking in the woods he couldnt say much, but then I realized a few feet from his car that im a minor (17) smoking a cig so I immediatly throw it down and stamp it out. The cop reels down his window and asks how im doing and I just play it cool and ask how hes doing and such. Then he asks me how old I am and I just tell him the truth and such since I was high and didnt feel like arguing or lieing to a pig or putting up w/ more shit then I should be while stoned so he asks for my ID and tells me to get in the back. Then he told me hes writing me a ticket for poces. of a tobacco product of a minor. I try and play it cool again and just say "you wont catch me smoking again" and asked if " I could just get a break" but he was a dick and continued to write it. Anyways he lets me out and I walked to school. So as im walking to school im checking out this ticket and I realize although it has my info on it he didnt put his signature, Id, div dist, or any other shit like that and I also notice he didnt ask me to sign the ticket. I also notice there isnt any fines or anything but some jibberish about appearing at court... there is no designated date but just an address listed. He also told me I "had" to call the court w/in 30 days but...idk. So my question is since there is no way to prove who gave me this ticket other then that someone did or that I was ever aware of getting this ticket does that mean I can justt throw it out? I'd rather not deal w/ this since im on probation and I figured I'd ask if I just got lucky or if maybe the cop actually did give me a break but wanted to scare me or see if I would just get myself in trouble by calling my PO about the offense or the court (I have to let them know in 3 days about any tickets I get) thanks Anyways... isnt that complete bs? I've been smoking cigs for a while now (not heavily or anything but enough and in 4 years I've never been stopped on the side of the street for smoking untill today) and this is like the 1st time ever a cop has actually told me something more then just put it out and thats only happened maybe twice... most the time they just drive right by and dont care. fuck.
Well i cant help you with any of that.. sounds like you may be able to pull off not going though. Anyway, thats odd, because i have never heard of cops actually stopping people for smoking cigarettes until today. And today, 3 of my friends got stopped, and got the same kind of ticket. But the information that was missing on yours is on theirs... WEIRD.
Wow.. what a dick. It had completely slipped my mind that cigs were illegal for minors. Never had trouble with the cops for that. Seems ridiculous.
I know man. slipped mine untill the 5o rolled up in front me and I was kinda going thru everything in my mind to make sure everything I had was legal but then I realized bout the cigs. funny thing is he didnt search me for my pack hahahah. btw thats crazy jah. today must be a bad day for us smoking minors. anyone know for sure tho about this ticket. im thinking since I didnt sign it even if I do get a notice about it or whatever after 30 days saying im fined there is still no way to prove I got it since even the cops copy doesnt have my signature on it. Basically it could have been some douche bag cop tryin to write up a kid he doesnt like but even at that there is no way to know or ask the cop since there is no info about the police officer on the ticket. idk... sounds like I could squeeze by.
yeah you can probably get it dismissed, call up a local lawyer tell him what you told us and he should tell you if you can get out of it.
Must be, I just seen a kid get busted and takin to the station for smoking a cig. JUST smoking a cig and they took him to the station. So I waited for the cop to pass before I lited mine.
sweet . well I'll ask around a little bit more but it sounds like I got lucky. if anyone can support or deny whats being said that'd be awesome. I just want to be sure. but yah. it has my general info (he got it off my ID), the offense committed, no officer info or signatures from him or any listed fines, under the court summons it just has the address listed. He did not ask me to sign the ticket. it clearly says its not an admission of guilt so im guessing the reason why you sign it is to show you are aware of getting the ticket. If I can I'll scan it and just blur out my general info.
