where can i find these? i'm supposed to be writing a paper, and my thesis is something like: "Peer to Peer (p2p) file sharing applications should be upheld as completely legal methods of private data transfer." i know there have been rulings upholding my opinion, that file sharing programs are legal, and not liable for what their users do, but i can't find the decisions. wouldn't those be public documents? like, Sony vs Universal, and the whole "are VCRs legal?" thing.
Search CNN.com or maybe the AP network. They have a website too. It doesn't come up much, mostly when major decisions are made.
Are you asking are the programs illegal? No, the programs their selves arent, they dont do anything illegal. They just connect users with files, im sure many people dont download illegal things but most do. They have no way of stopping any of it.

sure! there's a summary near the top.... the last paragraph in it is: The panel concluded, however, that the scope of the district court’s preliminary injunction was overbroad and remanded for the district court to modify the injunction as follows: Napster may be held liable for contributory copyright infringement only to the extent that Napster knows of specific infringing files with copyrighted musical compositions or sound recordings, knows or should have known that the files are available on the Napster system, and fails to act to prevent the distribution of the copyrighted material. Napster may be held liable for vicarious copyright infringement when it fails to affirmatively use its ability to patrol its system and preclude access to potentially infringing files listed in its search index.
