Original intent has a lot of serious flaws. It means things like cruel and unusual mean whatever they meant back in 1791. And like they said on a message board I was on once, in the phrase cruel and unusual punishment the "and" is very important. Punishments might have seemed cruel even then, but they weren't at all unusual.
