There is poster listing your state's Labor Laws posted somewhere in the store. Read it, carefully. I don't know Florida's laws, but in California it sounds like you are working a split shift ($ for you) and that "clock out and wait in the dinning room" might be considered on-call time (compensible at at hourly rate, less than your on-duty rate, but more than zero). Send something, in writting, to your store manager and the district manager. About your hours only. You are expected to help co-workers serve the guests. (Even if thats not your primary task.) Don't bitch about serving the guests. You are not a supervisor, how many breaks someone else takes is not your buisness. You are an employee, getting enough hours, and getting paid when you show up ARE your buisness.

I was posting some practical suggestions about how to stop this on the clock/ off the clock nonsense. i.e. learn the labor laws that apply to you and use them to your advantage. I've worked with a bullshit fast food joint for the past 3 years almost now and I can tell you if you plan on sticking around for long, read your employee handbook, learn your company's policies because when you signed your paperwork, you agreed to anything that's in there, period. Also learn your local labor laws, because holy shit, there's gotta be SOMETHING illegal with the way they run shit. I've been a team leader for almost two years and I can't see how making an employee clock in and out like that makes any sense at all. Is your manager seriously too stupid to make a schedule based on patterns? I don't believe for a second that there isn't some way to forecast sells and schedule accordingly, because my pissant company does it. if you are new you are the shop bitch. you have to do everything and hope someone notices the great job you do. follow orders as though you were in the military. if you show up for work, you ought to be paid for your time. i quit a job because i walked to work, and when i got there was told that they changed my schedule and i had to come back in 6 hours. it took an hour to fucking walk there! bam, fuck you bitch, you cut the fabric. but as far as being made to clock in/ out, YOU are scheduled for a number of hours each week, and you should not be docked hours 'because its slow' (theres always something to do) and if you are clocked out, you should not have to remain there. not having filled out an application seems suspicious too. it sounds like theres favoritism, and that means they'll screw the guy on the bottom no matter what, and thats not an opportunity for growth. if i were you, i would put in an application at a darden restaurant (olive garden and red lobster are the two main ones). they offer a lot, and if you decide to leave, and do it on good terms, then you ALWAYS have a foot in the door when you need a job. i have worked for 2 different olive gardens on 4 separate occasions. as long as you can handle the drama (whenever people work together theres drama, i hate people, but im a good pretender. i met carmelo anthony once, i thought he was a tall black man, and probably good at basketball.) its a regular check, you don't have to be a server, you can be a host, but being 20 you should be able to serve alcohol even though you can't drink it. or you could join the military. i did that, and since you are technically always on call, it works out to about $2.50 an hour. i think, its been awhile since i got a paycheck from them. good luck
decide to leave as in leaving olive garden in good terms or BK? the night manager not the lead gave me the job i was in needy of one so i justed showed up and worked the next day and no application. I been seaching for jobs on criagslist but men no one calls.......its annoying but i know the eco will get better in 5months?>... but i need a better job now! i guess that i have dishwashing experience i can apply again at this place i know.
in terms of the olive garden. fuck burger king, but make sure you have a backup job before you quit. restaurants are good because when times get tough, you can still afford to go out to eat for $30-50 and not feel like its a complete waste. i was making $8 an hour as a host for the OG. they have good stock options too. and darden promotes people within the company as a general rule. so if you stick with it you can eventually get basic bartending training for free through them. they rarely if ever hire an outside bartender. my hubby started out as a dishwasher. he has a hard time not letting people screw him in the workplace though.
I don't know the labor laws in your state, but here in Massachusetts: - If your employer asks you to report for work at a certain time your employer is required to pay you starting that time, whether there is work for you or not. - Any time your employer asks you to report for work, your employer is required to pay you for at least 3 (three) hours work, whether there is work for you or not. - Your employer is required to display a poster describing the state labor laws in a prominent location in your workplace. Please, learn the labor laws in your state.
