From what I understand, NY state has no option to expunge a ciminal conviction from court records, and a DWAI-drug conviction in NY state will elevate the next DWAI-drug or DWI offense commited within 10 years to a felony. It's another reason for the defense to fight the charge. Such offenses involving driving can stay on one's insurance record for up to ten years. Even if the criminal offense was expunged from court records, it's possible that the conviction can be inferred by employers and other groups by examining the insurance records of the person. It's one of the drawbacks of criminal offenses that involve driving.

does ny have a statute of limitations? Could just hop bail, if so. If not, it's obviously a really bad idea. And probably is anyways. But I think some places, for some things, if you run off they're happy.... they keep your money, you don't make any more trouble in their state, etc. It's sort of like a "or leave town" option, and though they win, you don't lose as badly.

Statute of limitations means that if you don't come to trial in a set amount of time, the charge evaporates. As I understand it. Wether or not you're ever caught, or you leave after being caught. Like, I know someone who had to leave a state because some corrupt locals caused him and his friends a spot of trouble (basically they all got thrown in a scary rapey samoan jail after being set up because they where little white boys). They all got on a plane and didn't look back, but he can go back (home) in a few years, because of a several year statute of limitations. He's got a driver's license, and all that sort of thing, never had a problem. Now if he was wanted for homicide, they would obviously care a bit more, maybe the shitty PD never even got the names positively linked with any particular identity in a system of any sort. Now, you do want to find a state without much extradition dealings with the state you left. Geographical distance should help. If it would cost them a lot to bring you home and they won't get money from you, even if you do get picked up, they will say to let you go. And some places they won't see or won't care about warrants from some other places. I'm not saying it's a good idea, it's a risky one. But if the law in his state makes it possible, it could still be a potential way out with no charge whatsoever.
It depends on the charge and location where you are now and where the state that the warrant was issued. Some charges, if pulled over, etc in one state... and they run your license and it pulls up the warrant, they would go ahead and arrest you, but they then would contact the agency that issued the warrant. It then depends if that state "wanted" you or if they were not going to pursue the matter (i.e. cost them more to extradite/have a hearing than original charge). This isn't likely, but sometimes they do not worry about extradition. Either way, once arrested, the agency issuing the warrant must pick you up within 30 days, or you will be released. It all depends on the charge, whether it was state or federal (federal... automatic extradition), and the state which crime occurred and your current state. More information is at 18 U.S.C. § 3182.

I know I'm chiming in here late...but I hate to hear you are going through this! I always heard that NY cops are more worried about serious stuff...which I certainly don't consider swerving a bit & causing no harm/not even leaving the road serious. C'mon, folks...for real. There was a study somewhere recently where they actually tested people's driving skills (of course under police supervision) after they had smoked weed. The testers were "experienced smokers", and THE RESULTS WERE THAT SMOKING WEED DID NOT IMPAIR THESE PEOPLE'S DRIVING SKILLS...much to the chagrin of the ones that were testing this. In fact, it was consistent almost across the board that people slowed down, seemed even more careful, and the biggest problem was them sometimes driving too slow. It was that dadblame phone that was ultimately your problem. I understand why you felt you felt you had to admit to smoking since his face was In Your's, and he probably could smell the old residual smoke. I wish you would look up that study...although I don't know that you would want to go that route in a court proceeding, because my experience has been that if you "win" against the police you wind up not winning anything! They will go after your ass like flies on a carcass. I just wanted to add that in so that you wouldn't feel so bad. Perhaps you may have needed a break, but this is still dang awful. Of all the advise given, I would also suggest PTI...your record will be in effect sealed, and it won't go against you for the rest of your life. It isn't cheap, but it would be worth it. Good luck.
