Is this considered cruelty?

I am 21 but the problem is she controls my life and will kick me out of the house if i dont obey her rules. I know people here will say, "well just move out" but I have nowhere else to go. Right now I am considering just taking my meds because I personally dont give a fuck anymore.

First of all, ask for your meds back, if she won't give them back, try to take them...if that isn't possible, tell her you are going to call the cops on her. She can get arrested for taking your medication, if it has your name on it. She will get charged with possession if you have them called without her knowing and they find them on her.

Second of all, it takes 30 days before you can evict someone, if they have been living at your residence for 7 days (30 days max, in other states) So, if you have been living there, and all of your belongings are there, she legally can not just throw you out, regardless if you are on the lease or not.

So I would threaten to call the cops on her, and if she thinks you are joking, go ahead and do it. Those are your fucking meds, mother or not, nobody needs to take YOUR meds, especially medications that help you with pain after a painful procedure like that.

If she refuses, call the cops, like I said. Then if she says to get your stuff and get out, tell her that you don't have to go anywhere, and that she is going to have to evict you if she wants you out.

It will take her lots of paperwork, and at LEAST 30 days before someone will physically make you leave the residence. After that long of a time, she might just give up. If not, you have a month to find a friend to stay with or something....

Personally you need to get the fuck out of there anyways, if you are 21 years old and your mother is taking your prescriptions for hydrocodone...one of the meds that is on the weaker end of the opiate chain...

 

The cops wouldnt do shit. All my mom would have to say is shes holding on to my meds so I dont abuse them and the cops would side with her, regardless of my age.

 

I would think that would only be if you are under 18. In the worst case, she would have to give them to you. Having someone elses prescription is a big no-no. Why dont you call your local sheriffs office and ask them what you could do? That way, if they actually CANT do anything, your mom would never be the wiser.

 

It's tough when you are dependant on your parents - but at 21 I think the cops would have to contact your mom - If they won't go over the cop who answered head. It's not right and it's cruel and she is ignorant for not knowing it. Dudley

Wrong. You are 21 years old. You are an adult. Regardless of WHO it is, nobody can hold onto YOUR medications...regardless of what the reason is.

So yes, they would do shit. If she refused to give them back to you, or if they caught her with them ON her, they would arrest her as well.

Just because she is your mother does not give her the right to hold onto your medication...no matter what she thinks you are going to use them for. They are YOUR medications. The only way she would be able to get away with this, is if you were under 18, like stated.

So yes, the cops would do something. They WILL arrest her if she refuses to give them back also, and they most likely will arrest her if they find her in possession of them.

For all of you people asking if she has a reason to withhold the meds, it does NOT matter. He is 21 years old, he is legally an adult, and those medications are in HIS name. It doesn't matter what the medication is, it doesn't matter that it's his own mother that is holding them, and it doesn't matter WHY she is holding them. It's illegal for ANYONE to be in possession of medication that is in another person's name, regardless of anything.

He could have a rap sheet longer then an SUV with arrests for abusing drugs, and she still would have NO control over HIS medications.

Trust me, they will arrest her. And I would have her fuck ass arrested for trying some bullshit like that at 21 years of age.

 

She thinks I will abuse them and I have told her countless times that she can even count them to make sure I am taking the proper amount, yet she still wont give them to me.

 

Doesn't matter - it's like withholding morphine from a cancer patient cause he abused it in the past. The Dr. think he needs them - he knows he needs them - he's 21 - what the fuck does him mom have to do with it?

 

I see that shit on cops all the time. 'Im holding it for a friend'. Guess what? They still go to jail. I dont see how your situation would be any different.

 

Like I said, it is illegal. I know I live in a different state, but I just called my local police station to ask them if something could be done...they informed me if the person is over the age of 18, and the prescription is in his name, it's illegal for ANYONE to have YOUR medication in your possession.

As I suspected, she can be charged with theft, and possession of a controlled substance. There is no law that states someone is allowed to take your prescription if they think you are abusing them, be it your mother or God.

It wouldn't be any different, I just checked with the local authorities here. She informed me that the laws on possessing another individuals medication doesn't vary much state to state...it is still illegal for her to be in possession of them, and she can still be charged with theft as well.

It seem as if you don't want to get your mother in trouble by making excuses like "it won't matter, she can do what she wants," but it isn't the truth. I don't care if that was my mother or not, if she was stealing MY medication and keeping me in pain, she would be sitting her ass in jail, and I'd be so opiated up it wouldn't be funny.

 

Thats not exactly my point, it appears that his mother is just worried of possible abuse of the drug, What I meant was has there been a reason that she is reluctant to give you the pills.

 

And when she does give them to me, 9 times out of 10 its before I go to sleep. What the fuck is the point of taking the meds if Im going to be asleep? Might as well not take any meds at all.

 

That pisses me off - even though I don't know you. That should cause a major crack in your relationship with - find a friend to crash with. You're 21!! It will be hard but man you need to make a stand or the rest of your life might be fucked up with her meddling!!

You know, i will tell her that it is illegal for her to hold on to my meds regardless if she thinks im abusing them. ill let you guys know what she says. probably wont be till tomorrow though cause im getting tired.

nah she doesnt watch me take them. i usually get the pill then make sure i have a drink in another room so i can say im going in the other room to take it with my drink and then i just pocket it.
