It is not standard procedure to shoot an unarmed suspect fleeing the scene. Case in point, an unarmed black male in my state was shot last year in the back while running away from an officer. It was all caught on someone's cell phone camera. The cop was charged with murder within a couple of days. But cops are trained to shoot to kill, period. They aren't trained to aim for a leg. And in this case, I feel the shooting was justified. The suspect was armed and didn't drop his weapon when instructed.

I don't really think someone's criminal record is relevant. Cops aren't judges or executioners. The only thing that really matters is - was the cop's life threatened? And I think in this case it was. And it would have been even if the guy had a clean record.

If he had the gun in his hand I would agree its the victim's own fault. Otherwise it is just assuming the worst case scenario what he would have done if shot in the legs. Although technically it would still be his own fault of course, but then the shooting to kill option should not be the standard.

I'm afraid your theory here is flawed. What makes him stupid is having an illegal gun and posing on a pic with it that can reach the general public. Most young men would pose with a gun (fake or not) when offered the opportunity. I know i did, just for fun and no: that lifestyle is not a guarantee for such pics at all.
