you're out of touch with the subject of the debate. portrayal of child pornography is a violation against obscenity laws. the book Lolita in no way violates obscenity laws. Nor do the film adaptations. you have the rights to write a book about pedophilia, but you do not have the rights to portray child pornography in video and sell it. We've already established what the law is, now it's time to talk about whether or not the law is justifiable and whether or not it is effective.
Great idea! I do have some concerns about the law, and how that could cross the line in the future. My problem is with "distributing". Does this mean selling obscene material or just making it available? That is worrisome. I do not want a law that busts people for screwing on cam and broadcasting it to their online friends for free.

distributing = selling. the obscenity laws are in place to control the porn industry. this law is not a threat to the constitution or anything people should be scared of. rudenoodle, the child pornography violation has been just recently brought up in this discussion. if it had been legal for him to do the things he does with legal-aged actresses, we wouldn't be discussing this as the case in which he got sentenced to prison only dealt with obscenity on terms of decency. So, in other words, pretend rape on video regardless of the age in which the actresses claim to be, is a violation of obscenity laws.
i believe the laws should be in place and i don't claim myself to be a christian. i might agree that the sentence was a little strict, but it definitely wasn't ridiculous or not justified considering all the rapist minds he fed the feeling of belonging in society to. How many people obsessed with rape do you think bought his films at a local porn store only to discuss it with local fuckhead pervs, and not feel like their thoughts are wrong? To me, that justifies prison time.
Why are people protecting the freedom of speech for a person who advocates the rape and sexual exploitation of a minor anyway? I mean, I don't understand why any person would say "hey, this art is soooo important for people to know about because it's a piece about a man having fucked up sexual rape fantasies and degradations of a minor because that it what some people are interested in." People who have children, have a vested interest into protecting the way that they are protrayed. I mean, what if the government funded a pornography film about a girl who says "I am 7 years old" and films her getting raped, puked on and cries out for him to stop by a man who is this Max Hardcore? Does that make it something that is legal to be distributed and accepted as a normative material to be passed around in our society? Seriously, some people have have their heads screwed on wrong when they perceive this type of thing to be seen as okay for anyone to sell and thinks that it is not the least bit obscene.
very good point. like i said before, some people who protect freedoms don't understand what makes freedom. by allowing something to exist that has the power to change standards in society, you are threatening other's freedoms. Like the freedom to not get raped by someone who doesn't see a problem with it because their country says it's ok to have thoughts about it. You have to draw a line somewhere so things don't get out of hand. If rape porn was acceptable in society now, maybe in 30 years snuff film would be the subject in question and allowing someone to actually commit violence on film would be the debate on forums. Laws set standards for society, and that is what they are meant to do. Some are wrong, some are right. Don't argue the ones that actually do what they are meant to do.

I don't think a lot of you understand that many people who seem totally normal are actually really kinky. It's not because we've been raped, everyone is different. some of us love intensity, and acting things out, various fantasies...we find it fun... I know so many people in this society who function like normal people, but in the "bedroom" they are total freaks. So many interesting posts and positions here on this thread. Some strong arguments for freedom of the films producer and the freedom of the actors who chose to perform in the film, regardless if the performance seems to be degrading to the actor. What about the factory worker who choses to work in a plant where there is contamination? Is there an argument for this workers free choice to work in a bad environment? I do hear the arguments out there for freedom of artistic expression. This guy is not making home movies for select audiences. He operates a capitalistic enterprise distributing film. Making a profit. He is not creating a sculpture or a painting. It's mass production, but fair enough. Can we view him from this angle. Does the consideration shown on the thread to the film producer extend to other capitalistic enterprises?

I agree with you 100%. To me, this case is not about freedom to engage in acts. It's all about friggin' money. Nothing else. It is not the sex that bother me, its the money. No one needs to buy the crap Max Hardcore is selling. There are couples on the net engaging in the exact same things, and all they ask for is maybe a "thank you." No contracts, no money, no lawyers, no jails. Just people doing what feels good. I support it completely. Max? He can rot in jail for putting a pricetag on sex.
