    That is a stupid interpretation of the law, its saying if it is recognizable by sight or smell, it gives the right to search.

    lol, sure does. I gotta say something here cause some people got a sort of naive mentality about cops.

    Even if they lie and there is no smell it holds up as probable cause. Cops can do whatever they want, I've been searched without being asked, or told what was going on, just started searching my car. I've been searched for walking down the street in shorts on a cold day in a rich neighborhood(no joke). And as far as them taking your money, yes they do that too. You think they can't do that cause it's against your 'rights' well welcome to bush's america where LEO might as well be spelled GOD. LEOs seized tons of my shit, all kept without proving there was any illegal money made on anything. I got a full time job in IT pfft I can pretty much afford anything I want within reason. Hell they didn't even *try* to prove any illegal money was used to pay for any of my shit, they just said they felt like keeping my car so they did.. along with everything in it, even schoolwork. they're just as criminal as anybody else, keep that in mind. Only difference is, they'll get away with it, you won't. Thousands in fines and lawyer fees later, I never got my shit back that was paid for with legal taxed money I made being a part of their filthy fucking machine. Nobody's arms are as long as LEO's.


    P.S. don't be surprised when you read the police report and notice a bunch of fabricated BS that seems to be pulled out of thin air.. they know how to cover their asses.

    All I know is what the 4th, 5th, and 6th Amendments of the Bill of Rights states. And a smell could be anything, just because the cop thinks she/he smells weed, she/he could be smelling something else. A cops "hunch" is NOT enough evidence and won't hold up in court.

    Before you reply you should read the entire post, like I said, a smell isn't evidence to be used in court, but if an officer who is considered capable of identifying an illegal drug by smell, and he smells it, he has the right to search your car.

    don't smoke in a public place, and suddenly when you spot a cop car you decide to turn ur vehicle on and drive away, not at all suspicious, thoa I guess a bunch of guys sittin in a park vehicle be suspicious too..

    For real man, people have to pull there heads out there asses and realize, just because it's "wrong" or "illegal" doesn't mean a cop won't do it. And yea, it's fuckin lame as hell how they can pretty much get away with anything.
