Trump was frustrated that Durham didn't publish an 'interim report' ahead of the 2020 election. The DOJ is known to not engage in such behavior because it gives the impression of trying to manipulate an election (which is what Trump wanted). Trump's attitude conjures up images of him sitting in front of the TV and chanting 'Hang Mike Pence' along with his rioters, like watching a football game with a cheer leading squad.
In the mind of Barrasso, if he, Trump, and Pence didn't hear the chants of the calls for Pence's death, it's not a problem. If anyone is after Barrasso to do harm to him, he can have great confidence in believing that no harm will come to him if he doesn't know about it.

Durham is going to have difficulty proving that Sussman lied to the FBI by (allegedly) not saying that he was working on someone's behalf. It involves a meeting that had a verbal exchange between Sussman and Baker in 2016 with no other witnesses. Baker has said that he can't recall if Sussman said whether or not he was working on behalf of another person or group. Even if Sussman didn't mention that he may have been working on behalf of someone at that particular meeting, it isn't necessarily proof that he lied. In September 2021, Durham wrote a 29-page narrative indictment about this one contention point, which for other prosecutors normally would have occupied a page. The Sussman trial will take place about 6 years after the meeting.
