    That post was in June 2023.

    As bad as jury nullification in ultra-conservative Fort Pierce sounded, it turned out to be far worse than jury nullification.

    Cannon threw out the entire documents case in July 2024 before it could even go to trial for a possible Trump win via jury nullification.

    Opinion: Judge Aileen Cannon is flat-out wrong, again

    excerpt:

    "After Watergate, Congress passed the Ethics in Government Act to create special prosecutors who could be removed only for cause and who were completely independent of the attorney general. The Supreme Court, in 1988, upheld the constitutionality of this statute. But after several lengthy investigations, including the Whitewater investigation of President Clinton, the act was allowed to lapse and was not renewed.

    A new mechanism was created to allow independent investigations but with more accountability. The attorney general appoints special counsels and by internal Justice Department regulations assures them of independence. This provides public confidence in the investigation that would be lacking without that independence, which is particularly desirable when the person being investigated is a president or former president or one of their family members or a high-level government official. Because of the Article II powers, this mechanism, as much as the earlier law, is constitutional.

    Special counsel Jack Smith could appeal Judge Cannon’s ruling to the United States Court of Appeals for the 11th Circuit. But that process will take months and it would ultimately likely go to the Supreme Court. The expeditious solution for this case is for Atty. Gen. Garland to have the Justice Department, through a U. S. attorney, refile the indictment against Trump. This would bypass Cannon’s problems with the special counsel."

    Cannon could have ruled as far back as February 2024 or even earlier. She sat on it for over four months until Clarence Thomas gave her the green light in early July by saying as part of his opinion in the presidential immunity ruling that he thought Jack Smith didn't have the authority to prosecute Trump, a statement he made as an extra that didn't have anything to do with the immunity ruling.

    Jack Smith is appealing to the 11th Circuit Cannon's dismissal of the documents case.

    Clarence Thomas is the Supreme Court justice who overseas the 11th Circuit.

    He is the sole member of the Supreme Court who used his opinion in the pro-Trump immunity ruling in July to inject his extraneous opinion that Jack Smith doesn't have the authority to prosecute Trump. Hearing the signal from Thomas, Cannon dismissed the documents case against Trump two weeks later.

    Questionable whether the six conservative members of the Supreme Court, Clarence Thomas in particular, and Aileen Cannon would be making such rulings if cases involved Biden or another Democrat instead of Trump.

    Special counsel David C. Weiss has prosecuted Biden's son and won a conviction, yet the conservatives don't seem to be saying that Weiss didn't have the authority to do it.

    If the conservatives on the Supreme Court and Aileen Cannon think that their rulings will benefit only conservatives, they are mistaken. What they have done is establish a vast playing field for protracted, ongoing legal battles, the ones that Chief Justice Roberts said he feared would happen if Trump wasn't granted immunity.

    Roberts' flimsy argument in the Supreme Court presidential immunity ruling was based in part on a remark George Washington made that stated that the U.S. needs an energetic presidency not mired by fighting between parties.

    The rest of his argument was mostly his personal interpretation of selected lines in the Federalist Papers that were written circa 1788.

    Trump Campaign Prepares Attack Plan for Harris in Case Biden Withdraws

    Another issue that doesn't seem to have been raised much is whether Biden will even remain president for the rest of his term.

    Biden could let Harris assume the presidency before the DNC convention as a way of removing himself from the picture if it is deemed he's too much of a detriment to the party. It would give Harris an incumbency advantage of sorts heading into the November election, albeit at the expense of Biden stepping down which arguably could be seen as a loss of incumbency advantage (it's a question of whether Biden being a sitting president is considered to be more of an advantage than how much of a detriment his physical and mental condition is currently perceived to be). It would also open up a VP position that could be filled by a new person to showcase for the election, although a new VP would require a majority vote in both houses of Congress.

    Presidents have promoted their VP to be the next elected president when the president has been in a second elected term and is not eligible to run again. In Biden's case, he is still eligible to run again but would still be president (assuming he doesn't leave the presidency completely) while promoting his VP to be the next president. It's a somewhat awkward position to assume.

    Harris would still be eligible to run for two more terms as president even if she currently assumed the presidency from Biden, similar to Johnson who was eligible to run for two more terms after serving as the VP for Kennedy because he hadn't yet completed two years as president during the remainder of the Kennedy term after his assassination.

    I think it’s over if Trump loses and is finally out of the picture. I don’t see any of the sons going very far at all. I don’t think they are as popular with the GOP and voters as everyone thinks. They’re popularity is from riding on daddy’s coattails.

    The two balcony muppet guys should run against each other for president in 2024.

    Same age group as Trump and Biden.

    But at least they'd be funny. And more intelligent.

    GOP quiet on Trump's unfounded claims that so many of his rioters were told by Capitol Police to go inside the Capitol.

    This has become Trump's stock lie to try to defend his riot. The riot is supposedly the fault of the police.

    Trump continues to claim his rioters were horribly treated.
