Mr. Garland has denied that he would have made such “a basic mistake about the law.” She ruled, “Since November 2022, Special Counsel Smith has been exercising power that he did not lawfully possess.’ All actions that flowed from his defective appointment … were unlawful exercises of executive power.”

    The 11th Circuit’s dismissal of the case could, though, amplify demands from Democrats that Attorney General Bondi release Mr. Smith’s final report on the Mar-a-Lago case. Judge Cannon determined that releasing the dossier while the case was ongoing would injure the due process rights of Messrs. Nauta and De Oliveira. Now that the cloud of criminal jeopardy has lifted, that logic no longer possesses the same salience."

    The 11th Circuit has granted a motion by the DOJ (now Trump's DOJ) to dismiss the appeal by Jack Smith to overturn Judge Cannon's dismissal of the documents case. In July 2024 Cannon ruled that Smith doesn't have the authority to prosecute Trump.

    It ends the documents case.

    "The dismissal of the case against two of President Trump’s co-defendants in Special Counsel Jack Smith’s Mar-a-Lago prosecution marks the end of the classified documents case that once threatened to convict Mr. Trump under the Espionage Act. He could have faced decades in prison.

    The case now ends, as the poet put it, “not with a bang but a whimper.” The final blow came from the 11th United States Appeals Court, which on Tuesday granted a motion from the Department of Justice to dismiss an appeal by Mr. Smith. The appellate ruling comprised but one line — “This appeal is DISMISSED.”

    Mr. Smith’s motion had sought to overturn Judge Aileen Cannon’s ruling that Mr. Smith was unlawfully appointed because he was, when named to the post, a war crimes prosecutor working for a foreign entity and had never been confirmed by the Senate. She dismissed the charges against Mr. Trump and two of his employees — his personal valet, Waltine Nauta, and Mar-a-Lago’s manager, Carlos De Oliveira. Her dismissal was “without prejudice,” meaning that the charges could be filed again one day, though that appears to be among the longest of long-shots."

    Speaker Johnson promotes requiring people work to receive Medicaid.


    House Republicans unveil blueprint to extend $4.5 trillion in tax cuts and lift the debt ceiling

    “If you add work requirements to Medicaid, it makes sense to people. It’s common sense,” Johnson said. “Little things like that make a big difference not only in the budgeting process but in the morale of the people. You know, work is good for you.     Judge Cannon could have dismissed Jack Smith a year earlier. If Jack Smith was ineligible in July 2024 when Cannon dismissed him, he was ineligible from the start. But she waited until Justice Clarence Thomas stated in an extraneous opinion that he thought Jack Smith was ineligible, and she road piggyback on him.

    Cannon has ruled that special counsel are ineligible to prosecute. It hamstrings Trump's administration unless it can formulate a novel remedy. It can't be both ineligible for prosecuting Republicans and eligible for prosecuting Democrats.

    The fate of the concept of special counsel in general is up in the air. Jack Smith has lost in the 11th Circuit. It could be appealed to the U.S. Supreme Court.

    Similarly, Trump can't enjoy the protection of the Supreme Court's presidential immunity ruling while at the same time trying to prosecute Biden who now has the same protection.

    The next best retaliation tactic for Trump is to prosecute Biden's associates. Biden shielded some of them from Trump by issuing preemptive pardons to people like Fauci and members of the J6 committee who investigated Trump, even though they didn't commit crimes.

    "The Energy and Commerce Committee, which handles health care spending, is asked to cut $880 billion over the decade, while the Education and Workforce committee is asked to reduce spending by $330 billion. The Agriculture committee is asked to save $230 billion, while the Transportation and Infrastructure Committee is asked to find at least $10 billion in cuts through 2034.

    Even as some programs would be cut, money would be shifted to other Trump priorities, including a $100 billion boost in defense spending over the next decade through the Armed Services Committee and an additional $90 billion for the Homeland Security Department, which is carrying out Trump's massive immigration deportation."

    Former VP Mike Pence and others have promoted the soft coup tactics of Trump by saying that Trump should be held accountable by history and the voters, not the justice system for his criminal behavior.

    Pence made his remarks about wanting history to be the judge of Trump after Trump's riot at the Capitol that could have left Pence injured or killed. It shows Pence's utmost loyalty to Trump, even when he's engaging in criminal behavior that put the life of Pence and his family members in jeopardy at the Capitol.
