Judge Cannon could have dismissed Jack Smith a year earlier. If Jack Smith was ineligible in July 2024 when Cannon dismissed him, he was ineligible from the start. But she waited until Justice Clarence Thomas stated in an extraneous opinion that he thought Jack Smith was ineligible, and she road piggyback on him. Cannon has ruled that special counsel are ineligible to prosecute. It hamstrings Trump's administration unless it can formulate a novel remedy. It can't be both ineligible for prosecuting Republicans and eligible for prosecuting Democrats. The fate of the concept of special counsel in general is up in the air. Jack Smith has lost in the 11th Circuit. It could be appealed to the U.S. Supreme Court.
Similarly, Trump can't enjoy the protection of the Supreme Court's presidential immunity ruling while at the same time trying to prosecute Biden who now has the same protection. The next best retaliation tactic for Trump is to prosecute Biden's associates. Biden shielded some of them from Trump by issuing preemptive pardons to people like Fauci and members of the J6 committee who investigated Trump, even though they didn't commit crimes.

Even as some programs would be cut, money would be shifted to other Trump priorities, including a $100 billion boost in defense spending over the next decade through the Armed Services Committee and an additional $90 billion for the Homeland Security Department, which is carrying out Trump's massive immigration deportation."
Former VP Mike Pence and others have promoted the soft coup tactics of Trump by saying that Trump should be held accountable by history and the voters, not the justice system for his criminal behavior. Pence made his remarks about wanting history to be the judge of Trump after Trump's riot at the Capitol that could have left Pence injured or killed. It shows Pence's utmost loyalty to Trump, even when he's engaging in criminal behavior that put the life of Pence and his family members in jeopardy at the Capitol.
