Well thats just terrible, but what can we do? the fact is that the entire society as a whole is there to blame for this. Turn on your TV and you will see your favorite shows filled with sad stories. I read one sentence on this thread where some one says that he likes to get raped ha! , now is that true? no , but he is curious like that cat that died(from "curiosity killed the cat"- not funny? sucks for you because it is funny for me ). Anyway, there should be a better way to educate these people and maybe there is a better way of educating a possible sexual predator so that he/she never comes even close to hurting another human being- this scenario would be similar to stopping mentally ill people from comitting suicide. And it can be possible to identify them before they commit crimes , latest research in this matter is showing some evidence that the minds of sexual predators have a different chemistry compared to the minds of "regular" people, So! the society can help by donating us chemists and neurologists some money and we can figure out a possible solution that will make everyone happy (or else!).

I doubt most of them are "cunning" just sick of being raped and beaten up. Some womyn have been abused their entire lives, and really feel they have NO other option. If there were more programs for abused womyn (more than just a few weeks of "therapy" and job training) I think the rate would go down. The schools should have more "abuse prevention" programs as well, as most abused womyn, start their first "romatic" abusive relationship in Jr High. THE most dangerous time in a battered womyn's life is the year after she leaves her batterer, this is the time she is most likely to be beaten the worst and most likely to be murdered.
Unless there is a record of it either through police reports or recent bruises then that defense should be next to useless.
Megara, you are saying that under the assumption that a- the women is not too scared to report abuse (current or prior) b- abuse is just physical. Emotional violence, intimidation, threatening to kill, threatening harm to children/pets of victim- ALL abuse. I understand that the referenced post WAS about physcial abuse, but self defense (in my opinion) could be very applicable.

I'm a bit confused what you're asking i'm just saying unless there are fresh bruises(god knows where old ones could be from, i have a ton) or a police history to corroborate a claim of abuse, i dont think that defense should be considered very much. I understand that a lot of women dont report abuse for whatever reason(fear most likely), but allowing such an excuse that cannot be verified tarnishes the justice of our legal system. Men need to have their rights protected too.
I am saying that lack of physical marks should NOT discredit a self defense testimony! What if a guy said for weeks "I will kill you" but never hit the woman previously? If someone is threatening to KILL you, you may be a but scared to call the cops- therefor no police record. Systematic emotional abuse IS still abuse and it IS self defense if the woman feels she is in danger. That is like saying a woman MUST have semen in her to prove she was sexually assaulted. I am to trying otbe confrontational, but this "no bruise= no self defense" would make many women victims twice- once by abuse and twice by people saying the abuse didn't happen
The problem is how can you prove this happened? Are we merely to believe a woman at face value? Convenient when the guy who could deny it is dead. Again, if she feels she is in danger she has an obligation to run. She cant take abuse for 30 years and just one day snap and kill him and expect it not to be murder. Unless she is in immediate danger and she is under threat of serious bodily harm..she does not have the justification to kill another person. When a person is convicted they are to be found guilty beyond a reasonable doubt. Now lets take this rape scenario. No bruising, no semen, no nothing that marks a guy to this woman charging rape. It is simply her saying "He raped me" and him saying "i did not." Do you think thats enough evidence to warrant sending someone away to jail for? I don't. Our legal system is based on evidence. How can we fairly and honestly punish someone when there is no evidence? Dont get me wrong, there is a place for verbal abuse in the legal system. Either someone else witnesses it OR it is used as circumstantial evidence and is one part of a case. Not the whole case.

You said it again. Hitting is not the only form of abuse and should not be treated as such. I do not disagree with you that the accused abuser and the abused deserve representation though. I would hate to be put in jail for something I didn't do just because someone said I did it. Because anyone can accuse you of anything.
It all depends on whether the "victim" fears for their life. Also, you can only use as much force as necessary to end a situation. If you can run away, YOU HAVE TO. If a guy says "i'm gonna kill you" and does nothing to put you in physical danger...you cannot walk into the other room, load the gun, come back and kill him. You are obligated to run away. How do we settle the issue of a he said/she said problem? Do we automatically take the word of the accuser?

Well, then do we automatically take the word of the accused? How many incidents of abuse actually have witnesses? How many times do the victims make excuses for the abuser? And try to hide any visible evidence because of the shame and stigma involved? Don't say that the victim is obligated to "run away" when you haven't been there. You have know idea what it is like.
